HDB Resale Power of Attorney: Sign, Register and Submit It Correctly

For an HDB resale, a Power of Attorney is not a casual authorisation letter.

Engage a solicitor, sign before the correct witness, register the instrument with the High Court Registry, and submit it through the HDB resale process.

A POA solves an inability to sign, not an eligibility problem

HDB says a buyer who cannot sign the Option to Purchase or legal documents personally must appoint a Power of Attorney. The document does not change citizenship, family-nucleus, financing or ownership eligibility. Complete the eligibility and financing checks separately. HDB’s sequence begins with engaging a solicitor to prepare the instrument. A generic template can omit transaction-specific powers or contain language that HDB cannot rely on. Give the solicitor the flat address, transaction role, parties, expected signing dates and whether CPF savings will be used.

Match the witness to where you sign

In Singapore, execution is before the solicitor. If you are already overseas, HDB lists a notary public or Singapore diplomatic or consular official, with a stricter overseas-mission route where CPF OA savings are used. After signing, the solicitor registers the POA with the High Court Registry. The resale application then records the appointment and includes the registered instrument. Ask for the registration reference and a clear copy that meets HDB upload requirements.

Example: A buyer is overseas, needs CPF OA savings and expects a sibling to sign the legal papers. The safe route is not a simple notarised letter: the buyer should instruct a Singapore solicitor, arrange execution through a Singapore Overseas Mission, register the POA and retain access for personal HDB declarations.

The donor still has personal endorsements

HDB resale procedures say donors using a POA still personally endorse the resale application and declaration forms, or sign them if they cannot access the portal. Do not plan on the donee replacing every online action. Test portal access while there is still time to solve a Singpass problem.

Legal drafting, overseas witnessing, registration and HDB review take time. A late POA can threaten OTP or submission dates even when the sale terms are settled. Work backwards from the resale deadline and add a buffer for couriering or corrected documents.
